Damn You, Alito!
So now the exclusionary rule no longer applies to the fruit of knock-and-announce violations. Great. Thanks so much, Supreme Court.
What am I to make of this? If a question on this point arises on the MBE, which presumably was written prior to this decision, how should I answer? Do I assume most MBE-takers will be aware of the change? What if I answer "correctly" as per Hudson v. Michigan, but nobody else does, and the MBE says I'm wrong and the question doesn't get thrown out? Huh? WHAT THEN? WHAT?????!!!!!
Bastards.
(To say nothing of what this means in terms of the continued devaluation of 4th Amendment protections...who has the energy at this point? Besides, if you don't like it, you must be a terrorist.)
